The South African law to be amanded
The talks about the legalazation of Cannibis and the new regulations surrounding the personal usage and permissible scale are currently underway. Cannibis were criminalized back in 1922 and decriminalized in 2018 by the Constitutional court of Law
The Constitutional Court of Law gave green light to the personal use of Cannibis, the Law came into effect on the 18th of September 2019. However the Parliament was given 2 years to amend the New Bill.
Medicinal effects of Cannibis over looked.
Before it was decriminalized, people were not allowed to be in possession of the plant (potential drug) under no circumstances.
The Law did not give exemption to medical purposes especially Traditional medicine. Cannibis were widely used by ancient South Africans for medical purposes. Traditional healers had to grow it iligally to cure their patients. Under the new law Traditional healers can use a limited amount to cure people, a dosage of 20mg is allowed for health supplements. The permitted amount for personal use is not yet regulated. The Court said it was within the Law enforcers’ jurisdictions to determine if the scale in a person’s possession is for personal use only.
In the new law, South Africans can see a permittable scale of more than a Kilogram per person.
The 24 months period given to Parliament by the High Court has come to an end. Parliament has to amend the current laws regarding sales, distribution, scale and usage of the Plant.
